
New Title: “Constitutional Amendment Safeguards Children’s Gender Identity at Birth”

The Hungarian Parliament adopted the fifteenth amendment to Hungary’s Fundamental Law on Monday, with members approving the legislation with 140 votes in favor and 21 against.
The amendment, proposed by government MPs, emphasizes that a person’s sex is a biological endowment that can be either male or female. It states that it is the state’s responsibility to ensure the legal protection of this natural order and prevent any attempts to alter the sex assigned at birth.
According to the newly amended Fundamental Law, every child has the right to protection and care necessary for their proper physical, mental, and moral development. This right takes precedence over all other fundamental rights, except for the right to life.
Furthermore, Hungarian citizens who hold citizenship in another state (excluding those with free movement and residence rights) now have the option to suspend their Hungarian citizenship as outlined in a cardinal law. The right to pay in cash has also been enshrined in the constitution to ensure the stability of the economy and prevent financial exclusion.
The amendment also prohibits the production, use, distribution, and promotion of drugs, reaffirming the state’s commitment to public safety and healthy lifestyles. It extends the service of prosecutors, except for the Supreme Public Prosecutor, until the age of 70.
Additionally, the government can now issue special legislative orders to suspend certain laws or provisions without the specific authorization of Parliament in a state of war or emergency, requiring temporary support from two-thirds of Parliament in a state of emergency.
A new clause emphasizes that the right to choose one’s place of residence must not infringe on the fundamental rights of local communities in Hungary to self-identity and protect their way of life and traditions.
These provisions related to the special legal order and the public prosecutor’s office will come into effect on January 1, 2026, while the rest of the amendment will take effect the day after its publication.
Constitutional lawyer Ifj. Zoltán Lomnici highlighted the importance of protecting traditional social values and norms against ideological pressures from the West. He stressed the dangers of ignoring biological reality and the societal implications of questioning fundamental concepts like gender identity.
In a world where social norms are constantly evolving, it is crucial to establish and uphold certain fundamental truths to maintain a stable and functioning community. The amended Fundamental Law aims to protect children’s gender at birth and preserve societal order based on biological and social realities.
