
Atalay’s Mandate to be Reduced Next Week

The Deputy Speaker of the Parliament from the AK Party, Bozdağ, will preside over the General Assembly of the Turkish Grand National Assembly next week. This decision was made by the AK Party Group and it will result in the reduction of Atalay’s mandate.
According to the regulations, Atalay or any other members of parliament have the right to file an objection to the Constitutional Court within 7 days from the date of dismissal. The objection can be made on the grounds that the decision is contrary to the constitution, law, or internal regulations. The Constitutional Court will then have to make a final decision on the annulment request within 15 days.
It has been indicated that after Atalay re-applies to the Constitutional Court, the controversial decision of the Supreme Court will be lifted and the Turkish Grand National Assembly will address the new decision of the Constitutional Court directly. The AK Party staff has cited Article 50 of the Law No. 6216 on the Establishment and Trial Procedures of the Constitutional Court, which states that if the violation is based on a court decision, the Constitutional Court will make a new decision in a new process, taking into consideration the ongoing interim court decision.
It is expected that the Constitutional Court will address the violation of rights stemming from the lack of action taken in accordance with the ongoing interim court decision and will likely decide on the release and reinstatement of Atalay. This decision will then be forwarded to the Parliament, which will be required to take the necessary actions accordingly.
