Cancellation of Authorization Certificate for Difficult-to-Sell Vehicle Dealers

Turkey’s Ministry of Commerce has published a new regulation to amend the rules governing the trade of second-hand motor vehicles. As per the new legislation, dealers are now required to obtain an authorisation certificate to engage in second-hand vehicle trading, with regulations determining the cancellation of the same. Under the new rules, authorised dealers are forbidden from selling a first-registered vehicle at a higher price than recommended by the manufacturer or distributor. Dealers are also barred from coercing consumers to purchase accessories and engaging in practices that make it difficult for consumers to obtain a vehicle. In case of any such violations, the authorisation certificate will be revoked and will not be given for a year from the date of cancellation. The Ministry also reminded businesses that impede the consumer’s access to goods that they are punishable under the Law on the Regulation of Retail Trade. Heavy administrative fines will be imposed on those who engage in such illegal practices, with the authorized dealers’ name being published on the Ministry’s website.
