The EU Commission Takes Action Against China’s Unfair Intellectual Property Practices
The European Commission has taken a strong stance against China’s unfair and illegal practices in the field of intellectual property. In a recent announcement, the EU Commission revealed that it has requested consultation at the World Trade Organization (WTO) in order to address these issues.
One of the main concerns raised by the EU Commission is China’s decision to give its courts the authority to determine binding royalty rates for EU standard basic patents without the consent of the patent owner. This move has put high-tech companies in Europe at a disadvantage, forcing them to reduce their copyright rates and allowing Chinese manufacturers to access European technologies at cheaper rates.
The EU Commission argues that China’s actions are in violation of WTO rules and unduly interfere with the authority of EU courts on European patent issues. As a result, the EU has initiated the consultation process as the first step in the WTO dispute settlement procedure to protect high-technology patent rights, especially in the telecommunications sector.
If a solution is not reached within 60 days through the consultation process, the EU may escalate the issue to the lawsuit stage and request the WTO to establish a panel to make a decision on the matter. The EU Commission is determined to fight against China’s unfair practices and protect the intellectual property rights of European companies in the global market.
