Family Assistance Reversed: Cuts Made in Response to Retirement

The Tax Council (KDK) has recently made a decision regarding a case involving the termination of family assistance payments to a former midwife in a state hospital in Turkey.

According to a statement from the KDK, the individual in question had been receiving family assistance payments for his wife, who is a civil servant, since she gave birth in 2003. However, when the individual retired in October 2021, the family assistance payments were abruptly stopped.

After noticing the cessation of payments in January 2024, the individual promptly filed an application, and the payments resumed in February of the same year. However, the KDK only approved a retroactive payment for three months – the period during which the individual was not receiving family assistance.

Unsatisfied with this decision, the individual appealed to the KDK for the payment of family assistance for the remaining months. After examining the case, the KDK deemed the termination of payments to be unjust and contrary to the law.

As a result, the KDK issued a recommendation to the Ministry of Health for the reversal of the decision and the payment of the outstanding family assistance. The Ministry subsequently notified the individual that the payments would be reinstated.

This case serves as a reminder of the importance of upholding both the law and principles of fairness when it comes to social assistance programs. The KDK’s intervention in this case highlights the organization’s commitment to ensuring that individuals receive the support they are entitled to.
