Former Soldier to Stand Trial for Alleged Murder of Homeless Man in New York Subway
Penny, a 24-year-old former soldier, appeared in court today to face charges of “second-degree murder” and “murder through criminal negligence” following the grand jury’s decision. The young defendant vehemently denied the allegations against him during the court hearing.

The incident in question occurred on May 1 when 30-year-old Jordan Neely, a homeless man struggling with mental health problems, reportedly displayed aggressive behavior towards subway passengers. Tragically, Neely lost his life while Daniel Penny, a former American Marine, attempted to restrain him by using strangulation techniques.
Penny was initially taken into custody after the incident but was later released. His defense attorney, Thomas Kenniff, argued that Penny’s actions were motivated by a desire to protect himself and fellow passengers at the time.
Eyewitnesses accounts suggested that Neely had shouted at the passengers but refrained from physically attacking them. The subsequent death of the homeless man sparked outrage and led to protests in the community that lasted for several days.
On May 12, Penny was rearrested and charged with “second-degree murder.” He was subsequently granted release on a $100,000 bail. Later, on June 15, a New York grand jury determined that Penny should stand trial on charges of both “second-degree murder” and “murder through criminal negligence.”
Military records indicate that Penny served in the US Navy for four years and was discharged with the rank of sergeant in June 2021. This case has garnered significant attention due to the racial dimensions involved, as the victim, Neely, was African American.
