Last Minute Milliyet: Married Women Gain Surname Freedom
The AK Party is preparing to submit the 8th Judicial Package to the Presidency of the Parliament, which includes significant amendments to various laws in order to enhance the effectiveness of the judicial system. The Ministry of Justice has sent the “Draft Bill on Amending Certain Laws in Order to Increase the Effectiveness of Judicial Services” to the Presidential Complex for finalization.
The proposed package, consisting of 67 articles, contains several important regulations. One of the changes includes allowing women who get married to keep their own surname instead of taking their husband’s surname. Additionally, mothers will have the right to reject the lineage between the father and the child. For those who adopt a child, their names can be listed on the child’s ID card.
Furthermore, the proposal includes provisions to increase the amount of prepayment for crimes requiring imprisonment and allows for appeals against decisions to postpone the announcement of the verdict. The package also introduces changes in the calculation of supervised release and conditional release periods for convicts.
Another significant amendment is the extension of the probation period to 3 years, while allowing certain categories of convicts, such as women with young children or those over the age of 70, to benefit from probation if they meet specific conditions.
The package also addresses issues related to coercive imprisonment in cases of violence against women and introduces the opportunity to apply to the Compensation Commission for individual applications alleging a violation of the right to be tried within a reasonable time.
Moreover, the proposal provides a pathway for repeat offenders to benefit from conditional release after spending three quarters of their sentence with good behavior, rather than serving the entire term in prison.
Other changes in the package include allowing lawyers with 20 years of seniority to become mediators without examination, revising the revaluation rate in monetary limits, and allowing appeals and objections against court decisions based on monetary limits.
The submission of the 8th Judicial Package signifies a significant step towards reforming and enhancing the effectiveness of the judicial system in Turkey.
