According to Mediator Lawyer Umut Metin, the recent figures on mediation show that many landlord and tenant disputes have been resolved through this system. Previously, parties had few options when it came to resolving disputes, but mediation has introduced a positive change. Instead of immediately resorting to litigation, parties are now encouraged to reach an agreement through dialogue and negotiation. This has reduced the overall number of court cases.

There are two types of mediation: litigation-based and voluntary. Litigation-based mediation is compulsory in certain disputes, such as employee-employer conflicts, rental disputes, commercial disputes, dissolution of partnership, and consumer disputes. Voluntary mediation, on the other hand, allows the parties to seek out a mediator to solve their problems without any legal obligation.

Two specific examples of mediation between landlords and tenants were provided by Metin. In one instance, parties avoided a year-long lawsuit by reaching an agreement through mediation. In another case, an annual rental dispute was resolved through a consensual agreement reached during mediation.

The success of mediation in resolving landlord-tenant disputes is evident from the decreased number of cases in court. Landlords and tenants now prefer mediation over costly and time-consuming litigation.

In conclusion, the number of voluntary mediations in Turkey has reached a record-high of 700,000 as of 2023. This indicates a significant shift in society’s attitude towards mediation as a more efficient and consensual approach to conflict resolution. Approximately 1.5 million people have opted for mediation to resolve their disputes, highlighting the successful impact of the compulsory mediation system.
