The Child’s Identity Denied to Mother at Birth

In a recent legal case in Konya, Turkey, a dispute over the custody of a 9-year-old child, D.T, has come to light. Born in 2016 at Selçuk University Medical Faculty Hospital, D.T has been looked after by his grandmother, YT, since birth. However, the child’s mother recently took action to obtain custody of D.T.
During the court proceedings at the Konya 6th Family Court, the lawyers representing the parents argued that they have made significant improvements in their lives, including overcoming drug addiction and living a stable life. They requested custody of their child, either jointly or solely to the mother.
On the other hand, YT’s lawyer emphasized the strong bond between the child and his grandmother, stating that she has been caring for him since birth. The lawyer also raised concerns about the parents’ past actions, including drug addiction and criminal behavior.
After careful consideration, the court decided to reject the lawsuit filed by the parents and allow them to see their child every 2 weeks. The decision was based on the Social Investigation Report, which highlighted the stable and nurturing environment provided by the grandmother for D.T.
Following the court’s decision, the parents decided to appeal the ruling. The Konya Regional Court of Justice upheld the lower court’s decision, citing the Social Investigation Report and reaffirming that the child should continue to live with his grandmother.
This case serves as a reminder of the complexities surrounding child custody disputes and the importance of considering the best interests of the child in such sensitive matters. Despite the legal battles, the ultimate goal should always be to provide a safe and loving environment for the child to thrive and grow.
