US to Grant Patents for AI-Assisted Inventions

The United States Patent and Trademark Office (USPTO) has announced new guidelines for determining the human contribution to the development of artificial intelligence in order to grant a patent. According to the guidelines, patent applications involving AI will now focus on the human contribution to the invention process, as patents are intended to reward and stimulate human ingenuity.
The document, titled “Inventive Guidelines for Inventions Made using AI,” was shaped by the feedback and results of public discussions. Citizens were asked to respond to 11 questions on the topic, and the USPTO began accepting comments on the draft recommendations in February 2023.
It is important to note that AI systems cannot obtain patents on their own, as the law specifies that only an individual can be considered the inventor. However, the document also clarifies that a patent can be granted to an applicant who has made a significant contribution to formulating the problem for AI. Additionally, the Office does not require the applicant to disclose information about the involvement of AI in the invention process.
