The Court’s Decision in Trend Garden Residence Case
The recent decision made in the case regarding the Trend Garden Residence, which collapsed during the first earthquake centered in Kahramanmaraş and resulted in the tragic deaths of 31 people, has garnered attention.
The case was heard at the Malatya 1st High Criminal Court, where a release decision was given for 4 suspects. The detained defendants Bülent Yeroğlu, Engin Aslan, Sefa Gülfırat, and Mehmet Gündüz SEGBİS, as well as the unarrested defendants Mustafa Tevfik Arpacı, Aysun Demir, Yasemin Yazıcı, and Mehmet Selim Doğan, were present at the hearing. Additionally, the defendant’s lawyers, the complainant, and the complainants’ lawyers all attended the proceedings.
During the hearing, the arrested defendant Bülent Yeroğlu argued that he designed the building and that the project was approved after the municipality’s inspections. Yeroğlu stated, “I completed the project, the necessary approvals were obtained, and the building was built. The building was demolished due to later renovations. The collapsed building is very different from what I designed.”
The court listened to the defendant and the defendant’s lawyers, the plaintiff, and the complainant’s lawyers, and also inquired about the prosecution’s request. The prosecution requested the release of the detained defendants, citing the stage reached in the trial, the significant amount of evidence collected, and the duration of their detention.
Ultimately, the court board decided to release the defendants with the condition of judicial control and a ban on going abroad, considering the large amount of evidence collected and the absence of evidence to be obscured at this stage.
