
Constitutional Court President Reveals Delays in HDP Closure Case

The President of the Constitutional Court, Kadir Özkaya, recently made statements regarding ongoing investigations and procedures within the court system.
According to Özkaya, the main investigation of the HDP closure case is still ongoing. This case is unique due to the nature of the indictment, with over 3 thousand prosecution and investigation files being presented as evidence. The rapporteur handling the case has been updating these files, but the process has been ongoing for 1 year and 6 months, leading to delays in completing the main investigation report.
Despite criticisms towards the Constitutional Court and tensions between various judicial institutions, Özkaya emphasized the importance of following legal processes, particularly when it comes to individual applications. He stated that in order for an individual application to reach the Constitutional Court, all prescribed application methods must be exhausted first.
One new mechanism that has been implemented in the Constitutional Court is consulting with the Supreme Court on cases that may impact jurisprudence. This collaboration aims to ensure a thorough and comprehensive review of legal matters.
In regards to specific cases like the Can Atalay case and the Gezi case, Özkaya mentioned that they will be evaluated as soon as they are ready for review.
Additionally, Özkaya addressed the issue of a Street Animals Law, stating that the court has instructed the rapporteur to focus on this file and put it on the agenda promptly to address public concerns.
