Criteria for Approval as an Organization and Technical Service Established

New Regulation on Approved Bodies and Technical Services Implemented by Ministry

The Ministry has recently introduced a new regulation, known as the “Approved Bodies and Technical Services Communiqué,” which has come into force after being published in the Official Gazette. This regulation outlines the obligations that organizations and technical personnel must adhere to in order to operate within the country.

Under this regulation, organizations applying for approval must submit the necessary information and documents to the Ministry for examination. If any missing or incorrect documents or information are identified, the organization will be given a grace period of 20 working days to rectify these deficiencies. Failure to correct the issues within this timeframe will result in the application being returned and will not be reconsidered for a minimum of 6 months.

Additionally, organizations are required to obtain accreditation from the Turkish Accreditation Agency within the technical regulation framework of their application. The final decision on the approval of an organization will be made by the Ministry, considering factors such as the industry’s needs, conformity assessment level, sustainability of activities, technical and administrative infrastructure, technical competence, performance, evaluation results, and complaints.

Once an organization is appointed, a notification will be published in the European Union New Approach Notified Bodies Information System for notified bodies and in the Notified Bodies and Technical Services Information System (ONTEK) for technical services.

The Ministry will monitor and evaluate the performance of these organizations at regular intervals, with the results being made public. Annual inspections will also be carried out to ensure that the organization maintains the required standards based on its assignment. Any deficiencies or inadequacies identified during these inspections must be addressed within 20 working days. Failure to do so may result in the suspension of activities through ONTEK and potential cancellation of the organization’s assignment.

Overall, this new regulation aims to enhance the quality and reliability of approved bodies and technical services in the country. By ensuring compliance with these guidelines, organizations can contribute to the improvement of industry standards and consumer trust.
