Justice Ministry Plans to Implement Private Enforcement Agents Institute
The Ministry of Justice in Kyrgyzstan is planning to introduce a new institution of private enforcement agents in the country. This initiative comes as a response to the current challenges faced by state bailiffs, who are responsible for judicial enforcement in the Kyrgyz Republic.
The Ministry has developed a draft law on amendments to several legislative acts related to enforcement proceedings. It aims to reduce the workload on government agencies, improve the efficiency and transparency of the enforcement process, and enhance the legal protection of all participants involved.
The proposed changes would allow private enforcement agents to seize funds and valuables in debtors’ bank accounts based on decisions of judicial and private judicial officers. They would also have the authority to access information considered as a bank secret in certain cases defined by law, to facilitate enforcement actions.
The Ministry believes that these amendments will expedite debt collection, protect the interests of creditors, and streamline the enforcement proceedings while lightening the burden on government agencies. Furthermore, provisions are being included in the Criminal Code and the Code of Offenses to establish the liability of private enforcement agents for potential offenses and to safeguard the rights of both debtors and creditors throughout the enforcement process.
Overall, the introduction of private enforcement agents is expected to bring significant improvements to the enforcement system in Kyrgyzstan, benefiting all parties involved in legal proceedings.
