Kyrgyzstan’s Parliament Passes Amendments to Criminal Code
The Zhogorku Kenesh approves amendments to Criminal Code on statute of limitations and early release
On April 10, 2025, the Zhogorku Kenesh in Kyrgyzstan approved a number of amendments to the Criminal Code in the third reading, specifically related to the statute of limitations and early release. This decision marks an important change in the legal system of the country.
Under the current Criminal Code, individuals who have committed a crime may be released from criminal liability if a certain period has passed from the day of the crime until the day the sentence becomes legally valid. For those who commit particularly serious crimes, this period is set at 10 years. However, in cases where a person is convicted of a crime that could result in life imprisonment, the court now has the authority to replace life imprisonment with a sentence ranging from 15 to 20 years if the statute of limitations is not applicable.
One of the key amendments introduced is the removal of the lower limit of the term. Going forward, if the court decides not to apply the statute of limitations to an individual facing a life sentence for a particularly serious crime, the new law mandates a 20-year prison term instead of life imprisonment.
Additionally, the approved bill includes provisions for parole eligibility for individuals who have compensated at least half of the damages caused by the crime. However, it is important to note that the amendments also stipulate that parole cannot be granted to those convicted of illegal production of narcotic drugs, psychotropic substances, and their analogues for the purpose of sale.
These amendments represent a significant shift in the Kyrgyz legal system, aiming to balance justice and rehabilitation while ensuring accountability for criminal actions. The decision reflects a commitment to enhancing the criminal justice system and protecting the rights of both victims and offenders in the country.
