Mehmet Uçum’s Application to Constitutional Court President Zühtü Arslan – Latest Turkey News
The debate surrounding the right to individual application to the Constitutional Court and the compliance with violation decisions has once again taken center stage.
Held today, the Constitutional Court witnessed the swearing-in ceremony of its new member, Yılmaz Akçil. The ceremony was attended by President Recep Tayyip Erdoğan, and during his speech, Constitutional Court President Zühtü Arslan addressed the ongoing debates regarding the right to individual application.
Arslan emphasized the obligation to comply with the decisions of the Constitutional Court, even if individuals may not agree with them. He stated that after a final judicial decision has been appealed, there is no legal basis for disregarding the decisions of the Constitutional Court.
Furthermore, Arslan highlighted the importance of the Constitutional Court in not only detecting violations, but also in demonstrating how these violations will be rectified and their consequences eliminated. He underscored that compliance with the decisions of the Constitutional Court is a constitutional obligation in a state of law, despite personal preferences.
In response to Arslan’s statements, Mehmet Uçum, Deputy Chairman of the Presidential Legal Policies Board, took to social media to assert that Article 153 of the Constitution does not encompass individual application violation decisions. Uçum also explained that “retrial” is not an independent institution in procedural law, and that the authority to decide on the renewal or extradition of a trial belongs to the courts involved in the original judgment.
