Ministry of Construction empowered to revoke non-compliant urban planning documents
A new pre-court dispute resolution commission has been established by the Ministry of Construction and Housing and Communal Services in Uzbekistan. This commission aims to streamline the process of reviewing urban planning-related documents and resolving disputes outside of the court system.
Previously, disputes over urban planning documents were dealt with through the courts, a time-consuming and bureaucratic process. Now, with the establishment of this new commission, legal entities and individuals have the option to appeal to this body for a quicker resolution.
Azamat Kholmuminov, an official from the Ministry of Construction, shared details about this new system with Kun.uz. The commission has the authority to annul any illegal or non-compliant documents related to urban planning.
Under the resolution titled “On the Procedure for Pre-Court Review of Disputes in the Urban Planning Sector,” adopted by the Cabinet of Ministers, an interdepartmental commission has begun operations to review and resolve disputes in the urban planning sector. This commission has the power to review various documents, including permits for construction and architectural-planning assignments, to ensure their compliance with urban planning legislation.
Azamat Kholmuminov explained that if a permit or document is found to be non-compliant, the commission will annul it. On the other hand, if it meets the legal requirements, it will be returned for implementation.
This commission operates nationwide and provides individuals and legal entities with a platform to file complaints regarding disputes over permits and related documents in urban planning. Complaints can be submitted through the ministry’s official website or in written or verbal form.
Overall, the establishment of this pre-court dispute resolution commission marks a significant step towards improving the efficiency and transparency of the urban planning process in Uzbekistan.
