Supreme Court files criminal complaint against Constitutional Court members

After the Constitutional Court’s decision finding a rights violation in the case of Atalay, the 3rd Criminal Chamber of the Supreme Court of Appeals has filed a criminal complaint against 9 Constitutional Court members who issued the violation verdict. This move has sparked a significant development in the ongoing legal battle.

According to information obtained by CNN TÜRK, a prosecutor at the Supreme Court of Appeals Chief Public Prosecutor’s Office has completed the legislative work, and the criminal complaint petition has been submitted to the Constitutional Court. It is noted that the petition was sent to the high court in accordance with Article 16 of the Constitutional Court’s establishment law.

The next step in the process will involve the General Assembly of the Constitutional Court. The issue of determining whether to open an investigation into the members against whom the criminal complaint has been filed will be discussed in the General Assembly. However, the members in question will not be able to attend the meeting.

The General Assembly of the Constitutional Court consists of 15 members, including the president and two deputy presidents. The board must convene with at least 10 members under the chairmanship of the chairman or deputy chairman, and decisions are made by absolute majority.

The filing of the criminal complaint against the Constitutional Court members indicates a new phase in the legal proceedings, and the coming days will be crucial in determining the next steps in this complex and high-profile case.
