The Court’s Ruling: İbrahim Keloglan’s Reasoned Decision
The court has announced its reasoned decision about Ibrahim Keloglan, the man who kicked and killed a cat in a residential building elevator. At the hearing on February 8, 2024, the Küçükçekmece 16th Criminal Court of First Instance sentenced Keloglan to 1 year and 6 months in prison according to the provision of Article 28/A-2 of the Animal Protection Law. However, the court reduced the sentence to 1 year and 3 months in consideration of the defendant’s future and the potential for rehabilitation. The defendant was also ordered to be released with supervision for 5 years and the sentence would be annulled if no further deliberate crime was committed during that time.
In the court’s reasoned decision, it was noted that Keloglan’s actions were deliberate, as he prevented the cat from escaping and repeatedly kicked it, killing the animal in the process. Nevertheless, a discretionary discount was applied due to his behavior and remorse during the trial process, as well as his lack of prior criminal record. Furthermore, Keloglan’s emotional and psychological state at the time of the incident was taken into account, with his claim of extreme stress and fatigue following a difficult conversation with his wife about their inability to have children.
The incident took place on New Year’s Eve in a site in the Ziya Gökalp District. Keloglan, who was seen in camera footage kicking the cat out of the elevator, was arrested on January 4. His defense stated that he was given the devastating news about his wife’s pregnancy test and reacted impulsively in a state of emotional volatility.
In his testimony, Keloglan expressed deep regret for his actions, acknowledging the terrible mistake he made and stating that he felt extreme shame for causing harm to the animal. The court took his remorse into account and imposed a reduced prison sentence with a period of supervision, allowing for the possibility of rehabilitation.
The entire case highlights the need for understanding the root causes of criminal actions and taking emotional and psychological factors into account when assessing appropriate punishment and potential for rehabilitation. Moving forward, Keloglan will have to adhere to the terms of his sentence and avoid committing any further deliberate crimes in order to have the sentence annulled.
