Disputes between Landlords and Tenants Resolved Through Litigation
Instances of conflicts between landlords and tenants being resolved through legal proceedings are becoming more common. Despite the drawn-out process between the parties involved, these disputes eventually find resolution in the courts.
In a recent real-life case shared by Lawyer Gizem Gonce with milliyet.com.tr, a property owner and tenant found themselves in a disagreement over an eviction commitment. The property owner, who owned a shop in the Grand Bazaar, requested an eviction commitment from the tenant after signing a lease agreement. This commitment was to be confirmed by a notary. Five months after the lease was signed, the tenant finally presented the eviction commitment prepared by the 6th Notary Public of Istanbul to the property owner.
However, when the time came for the tenant to vacate the shop, they refused, claiming that the eviction warrant was fraudulently obtained. In response, the shop owner initiated enforcement proceedings the following day based on the eviction commitment. The tenant objected to the eviction order and halted the proceedings.
The disagreement then escalated to a lawsuit. With the enforcement proceedings suspended, the shop owner took the matter to the civil court of peace. The court ultimately ruled in favor of the property owner, declaring the eviction commitment valid and ordering the tenant to vacate the premises.
Furthermore, the court determined that the tenant’s objection to the eviction commitment was unfounded and decided that the tenant would be responsible for paying the associated fees. Despite the tenant’s efforts to prolong the eviction process by objecting to the commitment, the civil court of peace swiftly validated the eviction undertaking obtained by the shop owner through the notary.
This case serves as another example of how legal intervention is sometimes necessary to settle disputes between landlords and tenants. Despite the complexities and delays that can arise during these processes, ultimately, the courts play a crucial role in resolving conflicts and ensuring justice is served.
