Yılmaz Akçil Takes Office as New Member of Constitutional Court
Yılmaz Akçil Sworn in as New Member of Turkey’s Constitutional Court
Yılmaz Akçil has officially taken his oath and started his duties as the newest member of the Constitutional Court in Turkey. President Erdoğan was also present at the swearing-in ceremony, along with Parliament Speaker Numan Kurtulmuş, Minister of Justice Yılmaz Tunç, ministers, deputies, and representatives of judicial bodies.
The ceremony took place at the Constitutional Court Supreme Council Hall. While the majority of important figures were in attendance, President of the Supreme Court of Appeals Mehmet Akarca and Chief Public Prosecutor of the Supreme Court of Appeals Bekir Şahin were notable absentees.
During the ceremony, President of the Constitutional Court Zühtü Arslan addressed the media and emphasized the importance of respecting the decisions of the Constitutional Court. He specifically touched upon the discussions surrounding “individual application” and stressed that the identity of the applicant does not factor into their consideration of the case.
Arslan also pointed out that the final authority to interpret and implement the constitution rests with the Constitutional Court. He made it clear that there is no constitutional or legal basis for not complying with the court’s decisions, even if there are disagreements or differences of opinion.
However, Mehmet Uçum, Deputy Chairman of the Presidential Legal Policies Board, responded to Arslan’s statements on social media. Uçum stated that individual application violation decisions are not covered under Constitutional Court Article 153 and clarified that “retrial” is not an independent institution in Turkey’s procedural law.
The tension between the Constitutional Court and the Presidential Legal Policies Board signals potential conflicts in the future. As Yılmaz Akçil assumes his role on the court, it will be interesting to see how these dynamics play out and how they may influence significant decisions in the future.
