UN Rapporteur Francesca Albanese Accuses Israel of Violating ICJ Decisions
Francesca Albanese, the United Nations Rapporteur, has accused Israel of violating the decisions of the International Court of Justice (ICJ) announced on January 26. In a statement to the British newspaper The Guardian, Albanese claimed that Israel is failing to protect the rights of Palestinians and is engaging in actions that could constitute the crime of genocide.
Albanese expressed disagreement with Israel’s interpretation of the injunctions announced by the ICJ. She argued that the ICJ decided that Israel should refrain from all actions that could constitute the crime of genocide, dismissing Israel’s justification that the actions are permitted as long as they are committed without the intention of genocide.
The UN Rapporteur highlighted the ongoing violence and destruction of civilian infrastructure in Gaza, making living conditions increasingly difficult for Palestinians. She emphasized that the lack of medical supplies, treatment, food shortages, and inadequate access to clean drinking water are contributing to the dire situation in the region.
Albanese also took to social media to share the news of her statement to The Guardian, asserting that Israel is not complying with the ICJ’s injunctions. She called attention to the hundreds of deaths, destruction, and displacement caused by Israel’s actions in Gaza, stressing the importance of respecting the decisions of the Court and urging states to take decisive action to prevent further oppression.
The accusations come in the wake of a lawsuit filed against Israel at the ICJ by the Republic of South Africa. The lawsuit, based on the violation of the 1948 United Nations Convention on the Prevention and Punishment of Genocide, led the ICJ to issue precautionary decisions on January 26. The Court ordered Israel to take immediate and effective measures to prevent acts that could constitute genocide, protect Palestinians in Gaza, facilitate the provision of basic services and humanitarian aid, and ensure the preservation of evidence of law violations.
As the situation in Gaza continues to unfold, the international community is closely monitoring the developments and urging Israel to abide by the ICJ decisions to prevent further suffering and upheaval in the region.
