Constitutional Court President Arslan Emphasizes the Importance of Complying with Court Decisions
President of Constitutional Court Addresses Law Faculty Students
President of the Constitutional Court, Zühtü Arslan, recently made a speech at a certificate ceremony for law faculty students who interned at the Supreme Court. During his speech, Arslan emphasized the three basic concepts in the qualitative dimension of the rule of law: reason, morality, and justice. He stressed the importance of adopting moral principles in order to be rational and free.
Arslan further highlighted the significance of individual application in protecting fundamental rights and freedoms in Turkey, stating that the Constitutional Court has been given the mission of protecting and developing freedoms through individual application. He also addressed the issue of non-compliance with violation decisions, stating that there can be no justification for not executing the decisions of the Constitutional Court.
The President of the Constitutional Court emphasized that differences of opinion or interpretation between courts or constitutional bodies cannot be a justification for not implementing the decision of the Constitutional Court. He urged all parties to act with common sense and resolve all issues, including the effective execution of violation decisions, solely on the basis of the law.
Arslan concluded by stating that the failure to enforce violation decisions can render the individual application remedy ineffective, and called for all issues to be resolved in adherence to the constitution and laws. His speech at the certificate ceremony served as an important reminder of the importance of upholding the decisions of the Constitutional Court and the rule of law.
