A new bill consisting of 22 articles that introduce changes in the judiciary is set to be presented to the Grand National Assembly of Türkiye (TBMM) with the goal of easing the burden of the judiciary in contested divorces.
One of the key changes proposed in the bill is the reduction of the period for re-filing a lawsuit from 3 years to just one year, with a request from either of the spouses being sufficient.
Legal experts believe that if the bill is approved, it will not only benefit the spouses going through a divorce but also have a positive impact on their children. The 22-article proposal covers regulations concerning the operation of notary offices on holidays, divorce proceedings, and appeal processes.
Lawyer Cengiz Hortoğlu emphasized that the current 3-year waiting period for re-filing a divorce case can be too long for the parties involved, leading to further conflicts between them. By shortening this period to one year, Hortoğlu believes that the overall stress and grievances experienced by the spouses can be significantly reduced.
Furthermore, Hortoğlu pointed out that under the proposed law, spouses will no longer have to go through the process of proving each other’s faults in court to obtain a divorce. Instead, they will have the option to file a new lawsuit after a year if their initial case is rejected, potentially encouraging a more amicable and consensual approach to divorce.
Overall, the bill aims to streamline the divorce process, reduce unnecessary conflicts, and create a more efficient and the effective judicial system for handling divorce cases in Türkiye.
