Half-Century Old Cold Case Finally Solved: Heirs Discovered after 47 Years
A Land Dispute in İzmir Resolved After 50 Years
In the Menderes district of İzmir, a long-standing dispute over a plot of land between Gülizar Cönk and four of her relatives has finally come to a resolution after five decades. The dispute began in 1974 when Gülizar Cönk filed a lawsuit for the cancellation and registration of the title deed.
Initially, the İzmir 6th Civil Court of First Instance ruled in favor of Gülizar Cönk on November 1, 1976. However, the decision was overturned by the Court of Cassation on May 4, 1977. Unfortunately, no action was taken by the local court following the Court of Cassation’s decision, and the case was forgotten on the shelf.
After 47 years, the case resurfaced when the heirs of the involved parties filed a lawsuit for the sale of the same real estate three years ago. It was revealed that the previous case had been abandoned, and efforts were made to locate the 30 heirs of the original parties.
The Menderes Civil Court of First Instance resumed the case after completing a file with 13 plaintiffs and 30 defendants. The court finally gave its decision on July 17, ruling that the real estate be registered in the name of plaintiff Celal Cönk, son of Gülizar Cönk, after 50 years.
The plaintiff’s lawyer, Erdoğan Zeren, expressed his satisfaction with the outcome, stating that while justice may have been served late, it is still a significant achievement in the legal profession. He emphasized the importance of delivering justice, even if it takes half a century to do so.
This case serves as a reminder of the enduring nature of legal disputes and the importance of resolving them in a timely manner to ensure justice for all parties involved.
