Uzbekistan Reforms Telecommunications Law to Promote Greater Access and Efficiency

Uzbekistan has taken a significant step towards modernizing its telecommunications sector with President Shavkat Mirziyoyev signing a revised version of the law “On Telecommunications” on December 27. This revision aims to eliminate the requirement for licenses for data transmission services for banks and online marketplaces, as reported in a document on Lex.uz.

The law, initially passed by the lower house of the Oliy Majlis in August and later approved by senators in October, underwent a comprehensive review process throughout 2023. One of the key changes in the new version is the provision that allows operators and providers to collaborate in using telecommunications infrastructure, communication channels, and the radio frequency spectrum through mutual agreements on tariffs.

Furthermore, the revised law transfers the licensing authority for telecom companies from the Ministry of Digital Technologies to an independent regulator. This regulator will be responsible for overseeing tariffs for communication services, establishing quality standards for universal telecom services, protecting users’ rights, and managing disputes between providers and operators. Additionally, the regulator will oversee the digital labeling of telecom devices.

The law also abolishes the need for licenses for data transmission network services for banks, payment systems, e-commerce platforms, and similar services. It also mandates that new construction projects, whether residential or commercial, must include provisions for telecommunications infrastructure and power supply, including shafts for various cables and security systems.

Operators and providers are now required to expand and develop their networks in coordination with government authorities, with the option to lay communication cables underground or along power line poles throughout Uzbekistan. The use of networks that bypass established protection systems and unauthorized transmission of international traffic through telecom networks are strictly prohibited.

Overall, these reforms are expected to promote greater access to telecommunications services, enhance efficiency in the sector, and drive economic growth in Uzbekistan.
