Constitutional Court President Emphasizes the Importance of Complying with Decisions
Constitutional Court President Zühtü Arslan recently delivered a speech at a ceremony, highlighting the importance of complying with the decisions made by the Constitutional Court. Arslan addressed the right to individual application, a topic that has been the subject of recent discussions.
Arslan pointed out that after final judicial decisions have been appealed and after the Constitutional Court has made its decision and interpreted it, there is no legal basis for not complying with the decisions of the Constitutional Court on the grounds of differences of opinion.
He also emphasized the importance of the Constitutional Court in not only detecting violations but also showing how these violations will be remedied and their consequences eliminated. Arslan stressed that the effectiveness of the individual application depends on the elimination of the violation, and it is an obligation imposed on the Constitutional Court by law.
Furthermore, he highlighted that the elimination of the consequences of the violation often requires a restoration to the pre-violation status, especially if the violation is caused by a judicial decision.
Arslan acknowledged that while individuals may not always agree with the decisions of the Constitutional Court and its interpretation of the provisions of the Constitution, in a state of law, it is a constitutional obligation to comply with these decisions.
