Woman to be Compensated for Double Mastectomy due to Misdiagnosis in Kocaeli
Çiğdem Kışlalı Wins Lawsuit Against Hospital and Doctors
In a recent hearing at Kocaeli 1st Consumer Court, complainant Çiğdem Kışlalı and her lawyers attended in hopes of securing justice for the medical malpractice she suffered. The complainant’s lawyer, Asuman Arslan, reiterated their previous statements and requested that the case be accepted.
On the other side, hospital lawyer Ebru Çiftçi, defendant doctor T.C’s lawyer Galip Onur Demirel, and other defendant doctor T.İ’s lawyer Emine Behiye Özkan requested the rejection of the case. However, the presiding judge ruled in favor of Çiğdem Kışlalı, ordering the defendants to jointly pay 25 thousand liras of pecuniary compensation with legal interest to accrue from the date of the case, and 200 thousand liras of non-pecuniary damages.
Unfortunately, Çiğdem Kışlalı’s ex-husband Ulvi Hamzaoğlu’s request for moral compensation was rejected. This outcome is a small triumph for those seeking justice in cases of medical malpractice. It sends a message that hospitals and doctors will be held accountable for their actions.
